Sendicate is an email publishing application for newsletters and email marketing.

Personally Identifiable Information and Sharing of Your Personal Information

Personal information about our Users and Subscribers is an integral part of our business. We neither rent nor sell your Personal Information to anyone. Sendicate may share your Personal Information only as described below.

Site Registration

To register to use the Services, you must provide Sendicate with your name, email address and password of your choice. (Note: Sendicate does not have access to your password.) You must provide truthful information to comply with the Site's terms as well as CAN SPAM laws. Upon registration, you will then receive an email to confirm your registration. By signing up to Sendicate, you consent to receive emails from Sendicate.

Customer Service

Sendicate requests personally identifiable information collected from you to contact Sendicate. To contact Sendicate, you must enter your first name, last name, email and any other information that you volunteer to provide through the Contact Us Form or any other forms of electronic or written communication. This information is used for allowing Sendicate to contact you, improve content of the Site, customize the content you see, and communicating newsletters, specials and new features to you. You can unsubscribe to the newsletter at any time.

Where Personal Data is processed for a public interest, in the exercise of an official authority vested in SmartrMail or for the purposes of the legitimate interests pursued by SmartrMail, Users may object to such processing by providing a ground related to their particular situation to justify the objection.

Users must know that, however, should their Personal Data be processed for direct marketing purposes, they can object to that processing at any time without providing any justification. What Choices Do I Have?

If you do not wish to receive email or other mail from SmartrMail or SmartrMail Users, please indicate by unsubscribing on the emails received, by indicating so on the Contact Us Form, or by contacting the SmartrMail User. Please note that if you do not want to receive legal notices from us, such as this Privacy Policy, those legal notices will still govern your use of the SmartrMail Service, and you are responsible for reviewing such legal notices for changes.

You may modify your account information.

You have the right to universally remove your data across SmartrMail and all it's senders. To do so please contact support@SmartrMail and our team will process the request within 72 hours.

How to exercise these rights

Any requests to exercise User rights can be directed to SmartrMail through the contact details provided in this document. These requests can be exercised free of charge and will be addressed by SmartrMail as early as possible and always within one month.

Subscriber Lists

The nature of the Service is to provide a newsletter service built off a Subscriber List that you can either enter manually or automatically through various opt-in functions through your website, etc. Your subscriber list must be comprised of email addresses of people who have expressly opted to receive communications from you.

Subscriber lists may not be sold, bought or otherwise be comprised from a third party subscriber list.

Email Newsletters

Information that you enter in to your Newsletter is at your discretion and must comply with the terms of this Website.

While the Newsletter Templates are customizable, the email footer is standard to ensure that the Newsletters comply with CAN SPAM Laws. Specifically, the 'unsubscribe' link will always be static on the Newsletter and the User will not be able to remove.

Third Party or Other Sites

Agents: We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. Unless we tell you differently, Sendicate’s agents do not have any right to use Personal Information we share with them beyond what is necessary to assist us.

Sendicate also utilizes a third party service to process credit cards for payments. Processing is directly through this service and Sendicate does not have access to nor will receive your credit card information.

Non-Personally Identifiable Information Collected Automatically:

  1. We receive and store certain types of information whenever you interact with our Site. When you use the Site, Sendicate automatically receives and records information on our server logs from your browser or mobile platform including your geo-location, IP address, cookie information, and the page you requested through a third party aggregator, such as Google Analytics.
  2. Generally, our service automatically collects usage information, such as the numbers and frequency of visitors to our Site and its components. Sendicate only uses this data in aggregate form, that is, as a statistical measure, and not in a manner that would identify you personally. This type of aggregate data enables us to calculate how often users use parts of the Site so that we can make the Site appealing to as many customers as possible, and improve those services. As part of this use of information, we may provide aggregate information to our partners about how our customers, collectively, use our Site. We share this type of statistical data so that our partners also understand how often people use their services and our Site, so that they, too, may provide you with an optimal online experience. Again, Sendicate will not, intentionally, disclose aggregate information to a partner in a manner that could identify you personally.
  3. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your mobile and computer's browser (the “Browser”) to enable our systems to recognize your Browser and tell us how and when pages in our site are visited and by how many people. Sendicate cookies are used for login information and session management.
  4. Most Browsers have an option for turning off the cookie feature, which will prevent your Browser from accepting new cookies, as well as (depending on the sophistication of your browser software) allowing you to decide on acceptance of each new cookie in a variety of ways.

System logs and maintenance

For operation and maintenance purposes, SmartrMail and any third-party services may collect files that record interaction with SmartrMail (System logs) use other Personal Data (such as the IP Address) for this purpose.



Business Transfers

In some cases, we may choose to buy or sell assets. In these types of transactions, user information is typically one of the business assets that is transferred. Moreover, if Sendicate, or substantially all of its assets were acquired, or in the unlikely event that Sendicate goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Sendicate may continue to use your Personal Information as set forth in this policy.

Legal Obligation to Provide Information

We may release Personal Information when we believe in good faith that release is necessary to comply with that law; enforce or apply our conditions of use and other agreements; or protect the rights, property, or safety of Sendicate, our employees, our users, or others. Is Personal Information About me Secure?

Your Sendicate Personal Information is protected by a password for your privacy and security. You need to prevent unauthorized access to your account and Personal Information by protecting your password appropriately and limiting access to your computer and browser by signing off after you have finished accessing your account.

Sendicate endeavors to safeguard user information to ensure that information is kept private. However, Sendicate cannot guarantee the security of user account information. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

The Site may contain links to other sites. Sendicate is not responsible for the privacy policies and/or practices on other sites. When linking to another site you should read the privacy policy stated on that site. This Privacy Policy only governs information collected on the Site.

What personal information can I access?

You can access and edit your personal information at any time through your User Account.


You may request to have your information deleted by Sendicate and Sendicate will do so within a reasonable amount of time. The non-personal information aggregated by the analytics will remain as, among other reasons, Sendicate has no control over that information.

How "Do Not Track" requests are handled

Sendicate does not support “Do Not Track” requests.

To determine whether any of the third-party services it uses honor the “Do Not Track” requests, please read their privacy policies.

Changes to this Privacy Policy

Sendicate may amend this Privacy Policy from time to time. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. If we make material changes in the way we use Personal Information, we will notify you by posting an announcement on our Service and sending you an email. Users are bound by any changes to the Privacy Policy when he or she uses the Service after such changes have been first noticed. If you have unsubscribed from all email communications from Sendicate, we will not email you changes to the Privacy Policy. You will still, however, be subject to the Privacy Policy changes.
